As a courtesy secondary service to promote system redundancy, **MasterVM USA LLC** executes automated incremental system snapshots of your virtual server instances on a strict **14-day cycle**. These backup images are stored and processed remotely within isolated hardware infrastructure located at the physical **Colocrossing Datacenters**.
While each distinct snapshot possesses its own localized technical availability configurations designed to facilitate restoration attempts, the Provider does not guarantee, warrant, or represent that any specific restore point can be successfully processed, deployed, or recovered back into a functional active environment.
Statutory Limitation of Liability
Absolute Exclusions of Liability (Wyo. Stat. Title 17 Compliant):
BACKUPS ARE PROVIDED SOLELY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY TYPE. **MASTERVM USA LLC** EXPLICITLY DISCLAIMS ANY STATUTORY WARRANTY OF MERCHANTABILITY, DATA PROTECTION, STORAGE REPLICABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE PROVIDER DOES NOT COMPREHENSIVELY OR REASONABLY GUARANTEE ONE HUNDRED PERCENT (100%) DATA COHERENCY, RETENTION, COMPLETENESS, OR RESTORABILITY FOR ANY ACCOUNT LOGS OR FILES. THIS ZERO-WARRANTY BACKUP LIMITATION APPLIES UNCONDITIONALLY TO BOTH COMPLIMENTARY PROVISIONS (FREE SERVICES) AND COMPENSATED SUBSCRIPTIONS (PREMIUM SERVICES).
**MasterVM USA LLC** assumes zero responsibility, liability, or financial obligation for any permanent or temporary data loss resulting from cyberattacks, malicious software, unauthorized third-party access, structural system compromises, or catastrophic node crashes (hardware failure of the host bare-metal infrastructure).
Customer Responsibility Mandate
It remains the sole, unalterable obligation of the customer to execute, verify, and maintain independent, encrypted, off-site copies of all production data, files, and configurations. In no event shall **MasterVM USA LLC** be held liable for compensatory, punitive, or consequential damages resulting from a customer's failure to maintain local redundancy.
Governing Forum & Venue
This Backup Policy and all relevant system agreements are constructed, interpreted, and enforced exclusively under the laws of the **State of Wyoming, United States**, without giving effect to any principles of conflicts of law. Any judicial claim, arbitration, or legal resolution arising under these policies must be initiated strictly within state or federal courts located in Wyoming.
