USDT/BTC Clause

1. Payment and Currency

The official currency of this Agreement is the **Euro (EUR)**. While **BACI Enterprise** ("the Company") provides the option to settle invoices using **Tether (USDT)/BTC**, the Customer acknowledges that the Euro remains the sole legal tender in the Republic of Kosovo.

2. Contractual Exchange & Tax Conversion

Payments made in USDT/BTC are accepted as a contractual exchange medium (payment in kind) rather than a direct currency payment. To ensure full compliance with Kosovo tax regulations, the following protocols apply:

• Exchange Rate: Determined at the moment of the transaction based on the spot price provided by Binance.
• Tax Conversion: For every transaction, BACI Enterprise accepts USDT/BTC and immediately converts the value to EUR for tax and accounting purposes.
• Invoicing: The official invoice will be issued in Euro (EUR) in compliance with ATK (Administrata Tatimore e Kosovës) regulations.

3. Finality and Fees

Non-Refundability: Due to Anti-Money Laundering (AML) regulations, the volatility of crypto-assets, and the immutable nature of the blockchain, all USDT payments are final.

There is strictly no "Send Back" policy; once a transaction is initiated to the Company’s wallet, it cannot be reversed or returned to the originating address.

4. Compliance and AML REQUIRED OVER 1,000 USDT

In accordance with the **Law on Crypto-Assets (Law No. 08/L-295)**, the Company reserves the right to request "Know Your Customer" (KYC) documentation for any transaction exceeding **1,000 USDT** to verify the source of funds. Suspicious payments may be frozen or refused.
